Welcome to Authfu. These Terms of Service ("Terms") govern your use of our passwordless authentication service ("Service") operated by Authfu ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Description of Service

Authfu provides passwordless authentication services including:

• Magic link authentication via email
• Optional two-factor authentication (TOTP)
• Session management and security controls
• OAuth 2.0 and OpenID Connect integration
• Developer tools and APIs

2. Account Registration and Use

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account and email access
• Notify us immediately of any unauthorized use of your account
• Use the Service only for lawful purposes
• Not share your account with others

3. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, phishing emails, or malicious content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or abusive activities
• Reverse engineer or attempt to extract source code

4. Service Availability and Support

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with advance notice
• Experience occasional downtime for updates and improvements
• Suspend service for security reasons or to prevent abuse

Our target uptime is 99.9% as outlined in our Service Level Agreement for paid plans.

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

6. Payment and Billing (For Paid Plans)

For paid subscription plans:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless required by applicable law
• We may change pricing with 30 days' notice
• Accounts may be suspended for non-payment

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Authfu, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any data you provide to the Service, but grant us the right to use it as necessary to provide our services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUTHFU, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Authfu and its affiliates from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately, and we may delete your account and associated data.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas, United States.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
